AND CONDITIONS OF SALE The following general terms and conditions
are in direct reference to the purchasing of services and products via internet
from the website "appenninogoloso.it", belonging to Appennino Vacanze
e Web s.r.l. Via Libertà, 53 41029 Sestola (MO). Each purchase is regulated
according to the provisions laid down in Decree no.185 of 22nd May 1999
and, regarding the protection of confidentiality, in accordance with the decree
196/03. Acceptance
of general conditions of sale The buyer, by sending confirmation of order
of purchase by e-mail, unconditionally accepts and is bound to abide by the here-below
general conditions and terms of payment in his dealings with Appennino Vacanze
e Web s.r.l, declaring to have read and accepted all information provided in accordance
with the abovementioned decrees. The present General Conditions of Sale must be
read on line by buyers visiting the website before confirming their order. The
sending of the confirmation of order therefore implies the total knowledge of
the General Conditions of Sale and complete acceptance thereof. The buyer, once
having completed the purchasing process on line, is responsible for the printing
out and conservation of the present general conditions of sale, already read and
accepted during the purchasing process carried out, so as to wholly satisfy the
conditions of articles 3 and 4 of the decree no. 185/1999. Purchasing
procedure The purchasing of our products, available as illustrated and
described on our website, is made by the buyer at the prices indicated, to be
confirmed upon the sending of the confirmation of the order, as well as transport
costs. Transport costs are visible during the ordering process and also upon closing
the order; transfer costs depend on the weight of the goods, the destination and
any protection necessary for mailing. Costs additional to mailing, such as the
right to payment on delivery, are clearly indicated upon completion of the order.
Before the confirmation of purchase, however, the individual cost of each product
chosen will be listed, as well as the total cost and the relative transport costs
and any additional costs. By confirming the purchase, upon completion of the transaction,
the buyer will receive an e-mail containing the date, total amount of the order
and details of the order made. Payment The payment for products
purchased and relative transport costs must be made by the buyer in one of the
following ways: 1. On line by credit card 2. In advance by bank transfer
Payment by credit card If paying by credit card, please note that
you will be charged in Euros. Depending on the exchange rate on the day of transaction,
there might be a slight fluctuation when converted into your local currency. The
circuits accepted for payment by credit card are Visa and Mastercard. The transactions
are dealt with by the Bankpass system of the Banca Popolare di Verona e Novara,
directly on the secure server of the bank itself. Appennino Vacanze e Web s.r.l.
is NOT informed of the credit card number. Appennino Vacanze e Web s.r.l. is
therefore not responsible in the case of eventual fraudulent or illicit use by
third parties of the credit card used for the purchase of our products. Advance
payment Payment can be made in advance by bank transfer to: Banca Popolare
di Verona e Novara, Fanano, IBAN IT07V0518866740000000001573 BIC/SWIFT VRBPIT2V420.
Goods will be sent once Appennino Vacanze e Web s.r.l. has received knowledge
of payment. Delivery of products Products will be delivered by
courier service. The buyer is bound to check that the package is intact, and neither
damaged nor wet. Only after having checked the package must the buyer accept the
delivery, after which no complaint can be made regarding the external characteristics
of the delivery in regard to the order made. Should goods delivered not correspond
correctly to the order made, the client must not accept the goods and must raise
complaint directly to the courier and send an e-mail info@appenninogoloso.it
Guarantee and exchange Damaged goods or goods not corresponding
correctly to those ordered must be returned within 10 days to Appennino Vacanze
e Web s.r.l. Via Libertà, 53 41029 Sestola (MO) along with communication
via e-mail with details of anomaly. Returns policy In accordance
with decree no. 185 of 22nd May 1999, the buyer has the right, within 10 working
days from receipt of ordered goods, to exercise the right of return. This right
does not extend to packaged products opened by the buyer even if not consumed.
Products must therefore be whole and untouched in content and in packaging so
as to qualify for the right to return. Again in accordance with decree 185/99,
the right to return goods is extended only to buyers definable as "final
consumers" and therefore only to physical persons who buy products for personal
use and are not acting with an aim to sell to third parties, therefore commercial
activities are excluded. To exercise the right to return, the buyer must send,
within 10 days from receipt of goods, a registered letter with return receipt

will proceed with the transmission of the order of reaccredit relative to the
cost of the goods sent and the first transport costs within 14 working days from
the dispatch of the goods by the buyer and, however, not before receiving said
goods. This operation will be carried out through the credit institute relative
to the credit card used or by accrediting the bank account indicated by the buyer.
The transport costs relative to the returning of goods to the sender are to be
paid by the buyer. We will not accept products returned, the return costs of which
have not been fully paid, or where the procedure and time limit laid down by law
(article 5, decree 185/99) for the communication of the exercise of return have
not been observed, or in the case where the product has not been packed in its
original packaging, or the product is not complete in its original content.
Place of jurisdiction The present contract is regulated by Italian
law. For any dispute relative to the validity, interpretation or execution of
the same contract, the territorial competence is the judge of the place of residence
or domicile of the consumer, if within the territory of the Italian state. |
